Terms and Conditions  

 1. BOOKING
The booking form must be completed by the party leader (the client) who must be over 18 years of age.
The receipt of the booking form by the owner from the client confirms the acceptance of the terms and conditions set out below and shall be binding on the persons intending to occupy the premises whether or not such persons have signed the booking form.
The terms and conditions will still apply even if for any reason the booking form has not been completed by the client e.g., in the case of a late booking requested by telephone that necessitates immediate commitment.
The booking is not accepted until the completed booking form together with the appropriate deposit has been received and the acknowledgement/receipt has been issued. If the booking is not accepted for any reason the deposit will be refunded in full.
Each booking form will be confirmed as soon as reasonably possible after receipt of the booking form and appropriate deposit.
The accommodation cannot be shared, assigned or sublet. Only the persons shown on the booking form are permitted to stay in the property. Persons/children under the age of 18 are not acceptable unless accompanied by parents or an adult. No pets permitted. No smoking is permitted inside the property.
 2. PAYMENT
A deposit of 20% per week is required to secure your dates.
Full balance is payable no later than 10 weeks prior to the date of departure, including a returnable security deposit of $350/£250.
The owner reserves the right to cancel if the balance of the sum remains unpaid nine (9) weeks prior to the date of departure.
All bookings made less than 10 weeks before departure are payable in full, and all booking conditions apply.
All telephone bookings will be cancelled if the deposit is not received within seven (7) days.
Payment can be made by check/cheque in $US or £GB. Credit cards also accepted, but additional charges apply.
The costs are for the entire villa (not per person) and include pool maintenance, cleaning, electricity, heating, fees, laundry of bedding, towels, etc. (stays of less than 7 nights, please add $125/£70 cleaning charge)
The only additional cost is voluntary - if you wish the pool to be heated during your stay, this will cost $140 / £90 per week. This is only likely to be necessary from October-March.
For bookings of 4 weeks or more, the pool heating rate is negotiable.

Prices are current as at Jan 2007 and the price stated is guaranteed not to increase after you confirm booking, no matter how far in advance you book, even if rates rise afterwards. Please e-mail for prices for periods after January 2008. 
 3. THE SECURITY BOND
The client is solely responsible for any damages, stains or breakage(s) that may be caused to the property or its contents and also for any loss of items in the inventory during their stay. Therefore a £250/$350 refundable security bond payable with the final balance will be held against such an eventuality. The villa is inspected both before and at the end of each occupation and upon confirmation that all is in order, this deposit will be refundable in full. Since it is not possible to check the accommodation before departure, the security bond will be reimbursed as soon as possible after return. Charges for damages/losses or any maintenance/repairs to the premises, equipment, amenities or fixtures necessitated by misuse or neglect will be at the discretion of the owners and will be deducted from the security bond. In the event of any damage/loss which is assessed to be in excess of the security bond, the client will be held responsible for full reimbursement of the outstanding amount within fourteen days.
It is important that the property be left clean and tidy at the end of the rental period. 

 4. THE RENTAL PERIOD
The villa is available for occupation from 4pm (local time) on the day of arrival until 10.30am (local time) on the day of departure. Vacating after 10.30am will incur charges equivalent to one day's accommodation cost.
At the end of the client's stay in the villa, the client shall lock all external doors, set the alarm and return the villa keys to the lock box.

 5. AMENDMENTS
The effective date of any amendment is the date on which details of the proposed amendment/s are received in writing.

 6. CANCELLATION BY CLIENT
All cancellations must be confirmed in writing directly to the Owners, by the person who made the booking. Cancellations by telephone will not be accepted. Deposits paid are not refundable unless the villa is re-let by either the Owners or the Management Company in Florida.
If clients should cancel, or the owner cancels the arrangements due to client failure to pay the balance within the time allowed before departure, a cancellation charge will be levied based on the following:

Note: All clients are strongly advised to have adequate travel/holiday/medical insurance in force for all members of the party and for the entire period of rental.
(Travel insurance may cover the cost of cancellation for reasons beyond your control.).

 7. CANCELLATION BY THE OWNERS
In the unlikely event that circumstances beyond the property owners' control necessitate cancellation of the booking, we will refund any monies paid by the party leader (without interest, compensation or consequential loss of any kind).

  8. CLIENTS
Clients are advised:
• To take out appropriate Holiday Insurance.
• That cancellation caused by clients due to incorrect documentation will be charged the relevant cancellation fees.
• To read the "House Manual" on their arrival at the villa.
• That the American sewage plumbing system to the property is only half the size of the UK's system. Therefore clients must be very careful as to what they flush down the toilets. 
 9. FORCE MAJEURE
The Owner accepts no responsibility or liability whatsoever for any loss or damage or alteration to the terms of the booking caused by events beyond the Owners' control including (but without prejudice to the generality of the forgoing) war, civil commotion, flight delays or cancellations, adverse weather conditions, fire, flood or industrial dispute.
 10. COMPLAINTS
Should a problem arise relating to the premises the Client should contact the Owners' Management Company in Florida immediately. Most problems can be resolved quickly and they are there to ensure you have a trouble free stay.
11. BROCHURE DESCRIPTION
All information supplied on this website is made in good faith and every care taken to ensure its accuracy, but no liability will be accepted in the event of any error.
 12. LIMITATION OF LIABILITY
The Owner of the premises accepts no responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects however caused. Guests are specifically requested not to allow unsupervised children in or around the pool. GLASS is not permitted in the pool area.  No diving is permitted in the swimming pool at any time.
13. LAW
This contract is subject to and shall be construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
